Tarkett Rewards Programme Terms & Conditions

Introduction
The Tarkett Rewards Programme (the "Programme") is a promotional incentive scheme offered by Tarkett Ltd ("Tarkett", "we", "us"), designed to reward eligible Flooring Contractors and Flooring Retailers (the "Participants") for purchasing qualifying Tarkett flooring products. Participation in the Programme is governed by the terms and conditions set forth herein ("Terms"). It is expressly understood that the beneficiary of the points and rewards under this Programme is the invoiced customer, namely the company making the qualifying purchases, and all participation must be with the full knowledge and approval of said company.

1. Programme Administration
1.1 The Programme is administered by Tarkett Ltd, with its registered office at 1 Dover Place, Ashford, Kent, TN23 1FB, United Kingdom. It is intended for Participants operating within the United Kingdom and Channel Islands.

1.2 Tarkett reserves the right to modify, suspend, or terminate the Programme at its sole discretion. Any such changes, including the discontinuation of the Programme, will be communicated to Participants with a minimum of 2 weeks' notice to their registered email addresses.

2. Eligibility
2.1 Participation is open to bona fide Flooring Contractors and Flooring Retailers who purchase Tarkett products either directly from Tarkett or through participating Distributors. It is a fundamental condition of participation that the invoiced company is recognized as the beneficiary of all points and rewards accrued, ensuring that participation is conducted under the company's authorization.

2.2 The Programme is not open to:

•  Employees or contractors of Tarkett Ltd or its affiliates, or their immediate family members;
• Employees or contractors of any Tarkett supplier involved in the Programme, or their immediate family members;
• Individuals under 18 years of age;
• Anyone in breach of any agreement with Tarkett or its affiliates;
• Any person or entity at Tarkett's sole discretion.

3. Qualifying Products
3.1 Standard Products: Eligible Standard Products include Contract Wood, Primo Safe.T, Safetred Serenity, Safetred Spectrum, Safetred Universal, and Safetred Wood. Standard Products are eligible for claims when purchased from participating Distributors, as listed on the Tarkett website [Dealer Locator].

3.2 Promotional Products: Tarkett may designate certain products as Promotional Products, eligible for claims whether purchased directly from Tarkett or through participating Distributors. Details, including the list of Promotional Products and their eligibility periods, will be communicated through the Tarkett Rewards platform.

4. Promotional Periods and Additional Points
4.1 Throughout the Programme Period, Tarkett may offer promotional periods during which additional Reward Points can be earned on specified purchases. These promotions will be detailed on the Tarkett Rewards platform, including terms and eligibility criteria.

5. Submission and Verification of Claims
5.1 Claims for Reward Points must be submitted through the Tarkett Rewards website, accompanied by valid invoices. Claims must be made within three calendar months from the invoice date. Late submissions will not be accepted.

5.2 Invoices can only be submitted once for claims. The Programme accepts purchases of a mix of product ranges, including full rolls, cut lengths, and full box quantities for tiles. Purchases must be rounded down to the nearest whole square metre for claims.

5.3 All claims will undergo verification by Tarkett. Points are awarded based on the confirmed purchase of qualifying products, with one Reward Point awarded for each whole square metre of product purchased. It is imperative that claims are submitted with the explicit approval of the invoiced company, reinforcing that the company is the beneficiary of the points and rewards.

6. Points Redemption
6.1 Reward Points are credited to the Participant's account upon successful verification of claims. Points must be redeemed within six calendar months from the date of award; thereafter, they expire.

6.2 Reward Points have no cash value and are redeemable for vouchers or other rewards as specified by Tarkett through the Programme platform. The redemption of points and the allocation of rewards are to be managed by the invoiced company, ensuring that rewards benefit the company as the Programme's intended beneficiary.

7. General Terms
7.1 Tarkett reserves the right to amend, suspend, or terminate the Programme at any time. In the event of termination or any significant changes to the Programme terms, participants will be notified at least 2 weeks in advance through their registered email.

7.2 Participation is contingent upon maintaining a good standing account with Tarkett and adherence to Tarkett's standard terms of business.

7.3 Tarkett's decisions regarding the Programme are final and binding. No correspondence will be entered into regarding such decisions.

7.4 Tarkett commits to the highest standards of data protection and will ensure compliance with all applicable data protection regulations. 7.5 These Terms are governed by the laws of England and Wales, and any disputes arising in connection with the Programme will be subject to the exclusive jurisdiction of the courts of England and Wales.

7.6 By participating in the Programme, Participants may opt-in to receive marketing communications from Tarkett. Participants have the right to withdraw their consent at any time by contacting us or through the unsubscribe link in the email communication.

8. Account Security and Website Use
8.1 Participants are responsible for maintaining the confidentiality of their account username and password associated with the Tarkett Rewards Programme. It is the Participant's responsibility to ensure that account credentials are not shared or disclosed to any third party.

8.2 In the event of any unauthorized access to a Participant's account, the Participant must immediately inform Tarkett Ltd. Tarkett will take reasonable steps to prevent further unauthorized access but is not liable for any loss or damage arising from the Participant's failure to comply with this security obligation.

8.3 Participants are also responsible for complying with all terms of use and/or Acceptable Use Policy governing the use of the Tarkett Ltd. website. This includes, but is not limited to, any actions that would compromise the security of the website, unauthorized use of the website's systems, or any engagement in activities that could harm Tarkett Ltd., its services, or other users.

8.4 Tarkett Ltd. reserves the right to suspend or terminate access to the Tarkett Rewards Programme for any Participant found to be in violation of these security and website use requirements.

9. Additional Provisions
9.1 These Terms and Conditions shall be supplemental to, and all purchases are, subject to Tarkett Ltd.'s standard terms and conditions of sale, available at [Tarkett's Terms and Conditions].

9.2 By participating in this Promotion, Participants agree to be bound by these Terms and Conditions and affirm that all decisions made by Tarkett Ltd. in respect of this Promotion shall be final and binding. No appeal or correspondence will be entered into.

9.3 Tarkett Ltd. reserves the right at any time to amend, delete, or add to these Terms and Conditions at its absolute discretion without prior notice. Participants are encouraged to review the Terms regularly for any changes. The latest version of these Terms will always be available on the Tarkett Rewards website.

9.4 If any matters arising from this Promotion are not covered under these Terms and Conditions, they shall be determined solely by Tarkett Ltd.

9.5 For the avoidance of doubt, cancellation, termination, suspension, or extension of the Promotion period shall not entitle eligible customers to any claims or compensations whatsoever against Tarkett Ltd. for any and all losses and/or damages suffered or incurred as a direct or indirect result of the said act.

9.6 Tarkett Ltd. accepts no liability for system errors, technical failures, data loss, or tax liability associated with this Promotion.

9.7 Nothing in these Terms and Conditions shall limit or exclude Tarkett Ltd.'s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other matter in respect of which it would be unlawful for Tarkett Ltd. to exclude or limit liability.

9.8 Tarkett Ltd. shall not be responsible for, nor shall accept any liabilities whatsoever howsoever arising or suffered by the eligible customers resulting directly or indirectly from this Promotion or rewards.

9.9 Personal data supplied during the course of this Promotion may be shared with third-party fulfilment providers and will only be processed as set out in Tarkett Ltd.'s Privacy Policy [Tarkett Privacy Policy].

9.10 Participants are responsible for the confidentiality of their username and password and shall immediately inform Tarkett Ltd. of any unauthorized access. Participants are otherwise responsible for complying with Tarkett Ltd. website terms of use and/or Acceptable User Policy.

9.11 All intellectual property rights related to the Tarkett Rewards Programme, including but not limited to trademarks, logos, and any promotional materials, are owned by Tarkett Ltd. or its licensors. Participants are granted a non-exclusive, non-transferable, revocable license to use such materials solely for participating in the Programme.

9.12 These Terms and Conditions shall be governed in accordance with English Laws, and the courts of England and Wales shall have exclusive jurisdiction in relation to any disputes arising from them.

10. Taxation and Legal Compliance
10.1 It is the sole responsibility of the invoiced company, as the beneficiary of the Reward Points and any rewards redeemed under the Tarkett Rewards Programme, to assess and comply with all applicable tax obligations, including but not limited to those set by HM Revenue & Customs (HMRC). This includes the responsibility to declare and, if necessary, pay taxes on the benefits received from the Programme.

10.2 Tarkett Ltd. does not accept any responsibility for the tax implications of participating in the Programme or for reporting any value received through the Programme to HMRC. The obligation to ensure compliance with all relevant tax laws and regulations rests entirely with the Participant and/or the invoiced company.

10.3 Participants are strongly advised to consult with their own tax advisors or contact HMRC directly to understand any tax implications that may arise from their participation in the Tarkett Rewards Programme.

10.4 By participating in the Programme, the invoiced company acknowledges and agrees that it is responsible for reporting and paying any taxes that may be due as a result of rewards earned or redeemed through the Programme. Tarkett Ltd. will not be liable for any failure on the part of the Participant and/or the invoiced company to comply with tax laws or regulations or to report or pay any taxes due.
